To expedite the management of any procedure, please provide the e-mail address with which you registered on the website and/or the order number, as well as the data and/or information that are relevant to identify and resolve the query efficiently. Cannactiva will respond as soon as possible and always within ten (10) calendar days of receipt.

These Conditions govern the use of the website, the registration of users and the purchases made through cannactiva.com.

Registration is not required to make purchases: the User can buy as a guest or create an account. In both cases, the User must provide truthful information and keep it updated. The Conditions of Use and Contracting are applicable independently of other specific conditions of purchase.

Cannactiva strives to provide accurate and updated information. In case of errors, they will be corrected after notification by the User. The information on the site is of an informative and commercial nature, without substituting professional advice. The information provided on this website about the uses or benefits of cannabis is for informational purposes only and is intended for the users' knowledge. We are not health professionals; Cannactiva products are not medicines. For information about medical treatments with CBD or cannabis, you should consult a specialist.

All the contents of the site (texts, graphics, logos, etc.) are protected by intellectual and industrial property rights of Cannactiva or third parties. Their reproduction, distribution or modification without express authorisation is forbidden.

To register and access specific services, the User must be over 18 years of age and provide truthful data. The password is personal and non-transferable, and the User is responsible for its confidentiality. Personal data is managed in accordance with the Privacy Policy. Registering does not imply accepting commercial communications: the sending of promotional SMS and e-mails requires separate consent, which the User may give or not and withdraw at any time.

The registration is valid until the User requests cancellation.

The User can close their account by writing to info@cannactiva.com from the e-mail address with which they registered. If they write from another address, they must provide the information necessary to identify the account holder.

The User may unsubscribe from commercial communications at any time, free of charge, using the “Unsubscribe” link in each e-mail, by replying STOP or following the link in each SMS, or by writing to info@cannactiva.com.

Cannactiva is responsible for ensuring that its products are in conformity with the contract and with the applicable regulations. Our products contain less than 0.3 % THC, below the limit of 1 % total THC set by Swiss law. Cannactiva makes reasonable efforts to ensure that the website works correctly, but cannot guarantee that it will always be available or free from technical interruptions.

The User must:

• Provide accurate information and keep it updated.
• Not disseminate content that is illegal, defamatory or infringes the rights of third parties.
• Not introduce malicious software.
• Maintain the confidentiality of their password.
• Not use the site for unauthorised advertising or commercial purposes.
• Access to and use of the website by minors under the age of eighteen (18) is prohibited.

Cannactiva manages personal data in accordance with the Organic Law 3/2018, the General Data Protection Regulation (GDPR) and, for Users resident in Switzerland, the Swiss Federal Act on Data Protection (nFADP). The data is used to manage the contractual relationship, comply with legal obligations and, with the User's consent or where the law permits, send commercial communications. The User may exercise their rights of access, rectification, erasure, objection, restriction and portability by contacting info@cannactiva.com, and lodge a complaint with the Spanish Data Protection Agency or, if they reside in Switzerland, report the matter to the Federal Data Protection and Information Commissioner (FDPIC). The site uses cookies to improve the User's experience and analyse the use of the site. The User can manage cookies from their browser. Non-technical cookies are only installed if the User accepts them in the cookie notice; continuing to browse without responding does not mean accepting them. More information in the cookies section of the Privacy Policy.

The User selects products, adds them to the basket, completes the order form and accepts the Conditions and the Privacy and Cookies Policy. The confirmation of the order implies acceptance and compliance with these Conditions.

Offers and discounts system

Cannactiva offers discounts automatically applied on the website, visible through promotional tags.

• Registered customers enjoy an additional 5% discount on the final price. This discount is applied after calculating the general discount visible on the website.
• Discounts can also be applied through promotional discount codes, either for specific campaigns, new customers, or special promotions. These discount codes must be entered manually during the purchase process and do not apply to products that already have a discount, except in special cases.

Payment policy

Prices are in Swiss francs (CHF) and include import duties and import taxes: orders are delivered duty paid (DDP), with nothing more to pay on delivery. Cannactiva may modify prices at any time; changes do not affect orders already confirmed. Shipping costs are indicated before completing the purchase. The final price shown in the basket reflects the total with all discounts applied. By confirming and processing the purchase, the User expressly accepts the final price shown in the basket.

In Switzerland, payment is by card only: credit or debit card (Visa, Mastercard), Apple Pay or Google Pay. Cash on delivery and bank transfer are not available. Payments are processed through our secure payment partner, QuickPay.

Card payments are charged when the order is confirmed. An electronic receipt will be sent to the e-mail address provided during the purchase process. If the User needs an invoice, they can request it by writing to info@cannactiva.com and indicating the order number.

Conclusion of the contract

Before confirming the order, the User can review and correct the products, quantities and their details in the basket and during the purchase process. The contract is concluded when the User confirms the order and the card payment is authorised; Cannactiva then immediately confirms the order by e-mail, with its summary. Cannactiva stores the order and the User can request a copy at info@cannactiva.com. In the Swiss shop, the purchase can be made in German, French, Italian or English.

Returns: Swiss law does not provide a general right to withdraw from purchases made online. Cannactiva voluntarily allows customers to return products within 30 calendar days of delivery of the order, under the conditions of the Return Policy. To request a refund, please contact our support team at info@cannactiva.com following the instructions in the Return Policy.

Payment Security: The website uses encrypted connections (TLS). Card payments are made on the secure platform of our payment provider, which complies with the PCI DSS standard; card data does not pass through our servers.

Disputes: Disputes relating to payments are subject to the law and the courts indicated in the section “Modifications and general”.

In case of errors in the information provided by Cannactiva, such as incorrect prices or erroneous discounts, we will notify you before shipping the order and you may choose between continuing with the correct price or cancelling it with a full refund of the amount paid.

We ship to Switzerland from our warehouse in Barcelona (Spain) with UPS Express: home delivery in 1–2 business days for CHF 9.90, free from CHF 80, or collection at a UPS Access Point for CHF 6. Import duties and taxes are included in the price (delivered duty paid): there is nothing more to pay on delivery. The shipping conditions (costs, delivery times, delivery attempts and what to do if the package arrives damaged) are detailed on the Shipping Policy page, which forms part of these Conditions. The shipping costs of each order are shown before it is confirmed. If the package arrives damaged, we ask you to let us know within 7 calendar days; this period does not limit the legal guarantee of the products.

The return and refund conditions are detailed in the Return Policy and in the Refund Policy, which form part of these Conditions. In summary:

• Customers may return products within 30 calendar days of delivery. This is a voluntary commitment by Cannactiva: Swiss law does not provide a right of withdrawal for online purchases.
• Products that are defective, damaged in transit or do not correspond to the order are covered by a three-year warranty from delivery (Cannactiva extends the two-year statutory period, art. 210 para. 1 CO); we ask you to notify us within 7 calendar days so that we can handle it quickly.
• In promotions with free units (2x1, 3x2, 1+1 free…), the refund is calculated proportionally over all the units received: see Returns of products on promotion.
• To return products, you can use the return form.

Cannactiva is liable for defects in the products under the Swiss Code of Obligations (art. 197 ff. CO). Warranty claims become time-barred three years after delivery: Cannactiva assumes liability for longer than the statutory two years (art. 210 para. 1 CO). This warranty is in addition to any guarantee offered by the manufacturer.

Please check the products when you receive them and let us know about any defect as soon as you discover it (art. 201 CO). If a product is defective or does not correspond to what you ordered, you may choose between receiving the same product again, a refund of the price on return of the product, or a price reduction if you prefer to keep it (art. 205 and 206 CO), without prejudice to the other rights granted by law. Cannactiva bears the costs of returning the product and of sending the new one.

Cannactiva may modify these Conditions at any time by publishing them on the website and informing customers. The modifications become effective upon publication and apply to orders placed from that moment on. These Conditions constitute the entire agreement between the User and Cannactiva, superseding any prior agreements. If any provision is declared null and void, the other provisions remain in force.

Contracts with consumers who have their habitual residence in Switzerland are governed by Swiss law (art. 120 of the Federal Act on Private International Law, PILA). We will always try to resolve any disagreement amicably first: write to us at info@cannactiva.com. If it is necessary to go to court, the consumer may sue Cannactiva before the courts of their domicile in Switzerland or before the courts of Barcelona; Cannactiva may only sue the consumer before the courts of the consumer's domicile (art. 16 of the Lugano Convention).

If the Customer does not buy as a consumer, the contract is governed by Spanish law, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG), and the courts of Barcelona have jurisdiction.

Cannactiva is liable for the damage it causes through breach of these Conditions under the terms established by law. For Users who are consumers, nothing in these Conditions limits or excludes the rights granted to them by consumer protection regulations.

Cannactiva is not responsible for the acts or omissions of third parties unrelated to it, except for those of the carriers and providers it engages to fulfil the order, for whom it is liable to the User until delivery.
